EMBARRASSING MOMENT FOR POPULAR KENYAN MP

Naivasha MP Jayne Kihara is counting loses after she lost property worth millions, including five luxury cars, to auctioneers.

The loss stems from a 10-year court battle the law make had been embroiled in with former National Campaign Against Drug and Substance Abuse chairman John Mututho.

A report by Nation on Monday, August 23 indicated that Tango Auctioneers and General Merchants possessed the properties from her after a court directive.

The property included five luxury cars as well as sheep and cattle.

It all began when Kihara filed a suit in 2008 after the then General Election held in 2007 protesting Mututho’s election after she was edged out.

Mututho hit back with an appeal at the Court of Appeal and Kihara was ordered to foot the bills he accrued during the suit.

Kihara filed a retaliatory appeal but lost and in 2016, she was ordered to pay a total of Ksh7.5 million to Mututho.

As of August 2020, Kihara was yet to settle the debt, which had ballooned to over Ksh10 million.

“Whereas Jayne Njeri Kihara was ordered by the judgment of this court passed on December 19, 2019 to pay the plaintiff the sum of Sh7,523107 as noted in the margin, and whereas the sum now due and payable in respect to the said decree is Sh10, 988,786.

“This is to command you to attach the movable property of the said petitioner,” read a warrant of attachment issued by the court.

In July 2012, Kihara had filed a petition seeking the court to block Mututho from demanding the money arguing that the sum was too much.

“There is also no controversy that the amount in question is very large – verging on Sh10 million when interest on the taxed amount is added.

Even considering the total monthly emolument of a Member of Parliament like the Applicant, that is a large sum of money for an individual to raise especially in circumstances where she believes that she will ultimately not be obligated to pay it,” the judge concurred with her.

In the latest development, Mututho confirmed that he would donate some of the funds to charity and “create forums to sensitize the public on the need to uphold our positive African values of respect to elders as well as peers.”
