LIST OF 13 GOVT OFFICIALS RUTO HAS NO POWER TO FIRE
The president is the most powerful man in the country and his powers can allow him to do many things.
As the head of the executive Ruto can employ, appoint and fire cabinet secretaries, principal secretaries, ambassadors, board chairs and heads of parastatals without consulting with anyone.
Despite these powers held by the president, there are some government employees that are immune to his powers. This means that he can fire them at any point. The only reason that can make them be removed from office include; Serious violation of the Constitution, Gross misconduct, Mental incapacity, Incompetence and Bankruptcy.
If any of the independent officers with the above problems is reported to the president he can not order for their resignation or retire. This is because they are protected by Article 251 of the constitution. The officers that can not be fired by the president are from the following departments;
1. Ethics and Anti-Corruption Commission
2. Auditor General
3. Controller of Budget
4. Public Service Commission
5. Judicial Service Commission
6. Commission on Revenue Allocation
7. Parliamentary Service Commission
8. Salaries and Remuneration Communication
9. Teachers Service Commission
10. National Police Service Commission
11. Kenya National Human Rights Commission
12. National Land Commission.
13. Independent Electoral and Boundaries Commission
If an officer from these offices must be removed from office a petition must be filed in parliament. The National Assembly will them determine if the stated officer should be investigated or not and the recommendation of the investigation presented to the house.
