LIST OF POWERFUL GOVT OFFICIALS RUTO CANNOT FIRE

When someone assumes the office of the President, you gets power that permits you to hire and fire at will. The president as the head of Executive has powers to employ and fire top government officials like cabinet secretaries, ambassadors, board chairs, heads of parastatals and principal secretaries.

Despite being an Executive, the president however has limited powers under article 248 and Article 251 of the Kenyan Constitution to fire and hire some top government officials. These officers’ job is secured as they only exit office once their tenure elapses.

Holders of these offices can only be removed from office under some serious circumstances such, gross violation of the Constitution of Kenya, Gross misconduct in the course of their duties, declared Mental incapacity, being incompetent, and or declared Bankrupt.

The holders of these offices, even if they are found guilty of any of the above offenses, the president cannot fire or order them to resign because the officers are protected by Article 251 of the Kenyan Constitution.

Below are some top officials that the president cannot fire or order their resignation:

1. The Chief of Defense Forces

2. Kenya National Human Rights Commission (KNHRC).

3. Independent Electoral and Boundaries Commission (IEBC).

4. National Land Commission (NLC).

5. Public Service Commission (PSC).

6. Judicial Service Commission (JSC).

7. Parliamentary Service Commission (PSC)

8. Salaries and Remuneration Communication (SRC).

9. Commission on Revenue Allocation (CRA).

10. Teachers Service Commission (TSC.

11. National Police Service Commission (NPSC).

12. The Ethics and Anti-Corruption Commission (EACC).

13. The Auditor General

14. The Controller of Budget.

In the event someone wants to remove any of the above member, then a petition must first be filed in Parliament asking for the removal. The president will then form a tribunal of inquiry to investigate the matter and recommend. This will them mark the beginning of removing such an officer from office.
