RUTO LOSES ANOTHER CASE AFTER RAILA’S HUGE WIN

President William Ruto’s Kenya Kwanza government has yet again lost another court battle, just a few days after the court suspended the proceedings of the Judicial Commission of Inquiry established by Ruto to investigate the Shakahola Massacre and religious organizations in the country.

The court made the ruling after Opposition Leader Raila Odinga filed a petition challenging President Ruto’s decision to appoint the commission.

In the latest court battle, the Kenya Kwanza government has lost an appeal case in which his government was seeking the Court of Appeal’s node to import Genetically Modified Organisms (GMO) maize into the country.

The Court of Appeal judges have established that the public concern was not being addressed in the government’s move to import GMO products into the country

Attorney General Justin Muturi On December 23, 2022, moved to the Court of Appeal seeking orders that would lift a ban on the importation and distribution of GMO crops in Kenya.

The Kenya Kwanza noted that lifting of GMO ban would solve the food problem in the country

“Applicant must establish the first two aspects, that is the arguability test and the nugatory aspect.

“Applicant must establish the first two aspects, that is the arguability test and the nugatory aspect.

“The public interest test was not meant to stand alone or replace either of the two tests. In our opinion, the Supreme Court introducing the public interest consideration did not dislodge the other considerations.

“See in Law Society of Kenya v Bloggers Association of Kenya & 6 Others (2020) eKLR. In the end, we find no merit in the application as the applicants did not satisfy us on all three limbs,” read part of the ruling.
